Elon Musk and James Franco will both testify on behalf of Amber Heard in the defamation lawsuit against her levied by her ex-husband Johnny Depp. The basis of Depp's suit is over her 2018 Washington Post op-ed, where-in she called herself a "public survivor of abuse", a claim which didn't directly name Depp, but rather insinuated him as an abuser. A claim his lawyers have denied repeatedly. 

Depp's attorneys have claimed Heard was unfaithful to Depp, alleging she had a relationship with Elon Musk a month after their marriage, a claim Elon's representatives have denied.

A video was recently given to the court showing Heard exiting an elevator around 11 pm only one day after the alleged abuse happened. She is seen leaving her apartment and then re-enters with a man, possibly Franco, who is wearing a low baseball cap to cover his face. He then turns his back to the camera as Heard is seen backing up, also covering her face. The two lean in and rest on each other before exiting toward Heard and Depp's apartment.

There are also photos from elevator footage of Heard wearing a blanket as Elon Musk holds her from behind as they ride the elevator to her and Depp's Hollywood apartment.

Clearly, these men are not Johnny Depp and this strengthens his case against Heard as they were married at the time these videos were taken. There are no timestamps on the images of Musk and Heard, so they cannot be dated. The timeline of when their relationship has been disputed by both Heard, Depp, and Musk, but according to the DailyMail, security guards have gone on record stating Musk visited Heard, both before and after she filed for divorce.
